Terms of Use for "PARAVOX" Network Test

Established on December 14, 2022

This Terms of Use applies to customers who participate in the network test (the "Test") of the game service "PARAVOX" (the "Game") provided by 81RAVENS PTE. LTD(the “Company”). By participating in the Test, customers agree to be bound by this Terms of Use and our Privacy Policy. Please note that those who do not agree to this Terms of Use or the Privacy Policy may not participate in the Test.

1. The Test

  1. The purpose of the Test is to test the official service of the Game, such as functions, operation, and server load, using a closed alpha version of the Game (the "Alpha Version"), therefore some services and functions thereof may not be available.
  2. During the testing period, we may upload information regarding hardware, software, and error logs, as well as customer data, from your hardware to our servers for the purpose of analyzing and improving the Game, without your individual consent.
  3. The dates and contents of the Test are subject to change without notice.
  4. The Alpha Version for the Test can be played free of charge, but customers will be responsible for network fees and other costs necessary to download and play the Alpha Version.
  5. Play data created during the Test will be taken over to the following versions including beta version. However, some stats and items may not be transferred and what kind of contents will be transferred is subject to the Company.
  6. Whether or not the official service of the Game will be launched, its specifications, price, launch date, etc., are matters to be determined at the discretion of the Company.
  7. During the Test, the operation may become unstable or you may not be able to connect to the server, which may prevent you from playing the Game smoothly.
  8. The service may be suspended or interrupted without notice due to maintenance, malfunction, or network failure.
  9. All or part of the play data may be initialized, or the balance of the Game may be significantly changed, without notice due to program updates, etc.

2. Use by Minors

  1. If you are a minor, you must review this Terms of Use and the Privacy Policy with your legal representative and obtain the consent of your legal representative before participating in the Test. If your legal representative does not agree to the Terms of Use or the Privacy Policy, you will not be able to participate in the Test.
  2. The Company may restrict the use of the Game, in whole or in part, depending on the age of the customer. The subject and content of such restrictions will be announced separately in the Game.

3. Customer roles and responsibilities.

  1. You shall comply with this Terms of Use when participating in this Test.
  2. You shall, upon our request, cooperate with us by reporting to us any defects in the software or operating environment of the Game that you discover during your participation in the Test.
  3. You shall not provide any information (including user IDs and passwords) registered with the Game to participate in the Test to any third party and shall not allow any third party to use your account (including co-using) and shall take full responsibility for its control.
  4. You shall be responsible for any actions taken on your account within the Test, regardless of whether you yourself took those actions.

4. Intellectual Property Rights

    All intellectual property rights and other rights pertaining to inventions, ideas, designs, trademarks, emblems, text, sound, music, images, video, software, programs, code, and other information in the Game belong to the Company or third parties to whom the Company has licensed their use.

5. Prohibited Acts

    When participating in the Test or using the Game, you shall not engage in any of the following acts:

  1. Violation of laws, court judgments, decisions or orders, or legally binding administrative measures,
  2. Acts that may be detrimental to public order or good morals,
  3. Provision of benefits or other acts of cooperation with antisocial forces,
  4. Infringement of intellectual property rights such as copyrights, trademarks, patents, honorary rights, privacy rights, or any other legal or contractual rights of the Company or any third party,
  5. Allowing a third party to use or dispose of the right to participate in the Test or the right to use the Game or data related thereto by means of lending, exchanging, assigning, transferring, changing the name of, selling, pledging, or otherwise, other than through a method approved by the Company,
  6. Sales, promotion, advertisement, solicitation, other for-profit activities, religious activities, or solicitation to religious organizations; sexual or obscene activities; meeting or dating with an unacquainted person of the opposite sex, displaying, or causing to be displayed, child pornography or information that constitutes child abuse, harassment or defamation of a third party, or any other activities that are not in accordance with the intended use of the Game,
  7. Posting or transmitting excessively violent expressions, explicit sexual expressions, expressions that lead to discrimination based on race, nationality, creed, gender, social status, family origin, etc., expressions that induce or encourage suicide, self-harm, or drug abuse, or other expressions that contain antisocial content and cause discomfort to others,
  8. Sending the same or similar messages to an unspecified number of third parties,
  9. Act of impersonating the Company or a third party or intentionally spreading false information,
  10. Unlawfully collecting, disclosing, or providing personal information, etc. of a third party,
  11. Unauthorized access, use of a third party's user ID, receiving multiple user IDs, and any other similar acts,
  12. Interfering with the servers or network systems of the Game, using BOTs, cheat tools, or other technical means to manipulate the service, intentionally taking advantage of malfunctions in the Game, making unreasonable demands of the Company by repeating similar inquiries more than necessary, etc.; or any other acts that obstruct or interfere with the operation of the Game by the Company or the use of the Game by a third party,
  13. Disassembling, decompiling, reverse engineering, or otherwise analyzing the source code, structure, ideas, etc. of the Game,
  14. Actions that assist or encourage any of the above-mentioned acts, and
  15. Other acts that the Company deems inappropriate.

6. Suspension of Use, etc.

    If you violate this Terms of Use, the Company may suspend participation in the Test or suspend, discontinue, or terminate the provision of the Game without any notice. The Company reserves the right to determine whether you have violated this Terms of Use.

7. Compensation for damages

    You shall be liable to compensate us for any damage caused by your breach of these Terms and Conditions or any other cause attributable to you.

8. Disclaimer

  1. We do not warrant, expressly or impliedly, that the Game is free from defects, errors, bugs, infringements, or other problems of fact or law (including defects in safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc.). We are under no obligation to provide the Game to you with the elimination of any of the problems above.
  2. The Company shall not be liable for any damages incurred by you as a result of the Game.

9. Changes to these Terms and Conditions and the Game

    The Company reserves the right to change this Terms of Use or the contents of the Game at its discretion as necessary. Any changes shall be notified in the Game, and shall take effect from the time such notification is made in the Game. Your continued participation in the Test following any changes to this Terms of Use or the Game constitutes your acceptance of the modified Terms of Use.

10. Privacy Policy

    We protect the personal information you provide to us in accordance with our Privacy Policy.

11. Non-exercise of rights

    The Company's failure to exercise any right under this Terms of Use or laws and regulations shall not constitute a waiver of such right, and the Company shall remain entitled to exercise such right.

12. Prohibition of transfer of rights

    You may not transfer all or part of your rights and obligations set forth in this Terms of Use to any third party.

13. Separability

    If any provision of this Terms of Use is held invalid, illegal, or unenforceable, the constitution, legality, and enforceability of the remaining provisions shall in no way be impaired or affected.

14. Governing Law and Jurisdiction

    This Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute between you and the Company arising out of or in connection with the Test or the Alpha Version shall be subject to the nonexclusive jurisdiction of the Republic of Singapore.
